Egg before the process for “farm fresh” eggs.

Grocery chain Kroger has won a lawsuit dismissing claims it misled consumers by using the familiar “farm fresh” label to describe eggs that come from caged hens in industrial environments, according to Reuters.

A federal district judge in Chicago ruled that reasonable consumers would disagree with plaintiff Adam Sorkin that “farm fresh” does not necessarily mean chickens “that live on farms with open green space, grass, hay and straw,” he reported television service.

Mr. Sorkin claimed he paid a premium for “farm fresh” eggs under one of Kroger’s labels and would have paid less or not bought them if he had known their origins.

But in dismissing the proposed class action, the judge distinguished “farm fresh” from descriptors like “cage free,” “free range” and “pasture raised,” which actually describe the chickens’ living conditions.
