Legal point of view: The High Court provides clarity on the assessment of merger proposals

The High Court dismissed an appeal by the London Borough of Lambeth against an inspector’s decision to grant a lawful development certificate (LDC) and planning permission for the amalgamation of two flats into one flat. The decision provides useful comments from the court on the London Plan’s policy on mergers, the principles of significant change of use and the procedure for late submissions in a planning appeal.
