Man who had sex in public and drink drivers among those convicted Cornwall courts told

It’s the weekend and so time to take a look at the cases that have recently come before magistrates in Cornwall. Everyone who has been charged with a crime, from the most minor to the most serious, initially appears before magistrates.

The most serious cases are then sent to the crown court. If a defendant pleads guilty, they could be sentenced immediately or the matter could be referred for a pre-sentence report. If they deny the charges against them, the case will be adjourned for trial.

Courts are open to anyone, and our reporters participate just like any other member of the public. Since most people have jobs and cannot spend time in court, the media has always acted as the eyes and ears of the public to ensure that justice is seen to be done.

Here’s who was recently sentenced at Bodmin and Truro Magistrates’ Court.

Sean Shipley

Age: 35

On March 1, 2024, in Leader Road, Newquay, assaulted a man. On the same day and at the same place, he used violence in order to gain entry to the premises, knowing that there was someone in that location who was opposed to that entry.

You also, without lawful excuse, damaged a front door of property valued at an unknown amount at this time belonging to your victim, intending to destroy or damage such property or being reckless as to whether such property would be destroyed or damaged.

Community order with mental health treatment for 12 months. Rehabilitation activity: 25 days. Unpaid work: 200 hours. Restraining order not to drive on Leader Road in Newquay until June 27, 2026.

Karen Hitchens

Age: 53

On March 27, 2024, at Morrisons in Pool, when he was suspected of driving a vehicle and asked to provide a specimen of his breath for analysis under section 7 of the Road Traffic Act 1988 in the course of an investigation for to establish whether you have committed an offense under section 3A, 4, 5 or 5A thereof, failed without reasonable excuse to do so.

Disqualification period: 20 months. Fine: £270.

John Haynes

Age: 50

Albert Place, Truro

On May 28, in Daniell Road, Truro, stole a package of miscellaneous items to the value of £57 belonging to Simon Johns. On May 22, also in Daniell Road, Truro, stole a package of miscellaneous items to the value of £28 belonging to John Harvey.

On March 21, at Moorfield Carpark in Calenick Street, Truro, without lawful excuse, damaged a vehicle WK69 KVS to the value of £50 belonging to Susan Sutton, intending to destroy or damage such property or being reckless if such property will be destroyed or damaged.

On March 27, in Tesco, Truro, entered as a trespasser a building, namely Tesco, with intent to steal. On May 11, in Lemon Street, Truro, stole a pedal bicycle to the value of £900 belonging to Robin Wilding. On March 21, in Walsingham Place, Truro, trespassed into a building, namely Sabzi Deli, stole an iPhone and Ipad, knives and cash to the value of £325.

Community order. Curfew with electronic monitoring for five months. Rehabilitation activity order: 20 days. Total compensation: £4,270.77.

Age: 32

Glen Leigh, Redruth

On April 19, at Street Record, Bucketts Hill, Redruth, used a motor vehicle without insurance. On the same day and in the same place, he drove a vehicle without a driver’s license.

On the same date, a person in the same place drove a car while intoxicated, having consumed so much alcohol that the proportion of alcohol in his breath, namely 42 microgrammes of alcohol in 100 milliliters of breath, exceeded the prescribed limit .

Also on the same date at Treliske Hospital in Truro assaulted a police officer, acting in the performance of his duties as such officer, by beating him.

Community order. Rehabilitation activity order: 25 days. Unpaid work: 140 hours. Compensation: £150. Disqualification period: 16 months.

On 25 November 2023, at Phoenix Wharf, Malpas Road, Truro, committed an act which offends public decency by behaving in an indecent manner, namely being naked and engaging in sexual activity with a female.
