TikTok to get 15 minutes viral in ban attempt

The ongoing fight over TikTok is finally reaching a crescendo, leaving the app’s 170 million loyal US users on the edge of their seats.

In April, US President Joe Biden signed a law that could ban TikTok from legally existing in the US unless ByteDance, its parent company, sells the social media app to another company within nine months .

However, this fight against TikTok has been going on for years without a solution.

The Banning TikTok on Government Devices Act was passed in December 2022, requiring TikTok to be removed from federal agencies’ information technology.

The TikTok ban comes amid growing concerns from the US government that the social media app poses a serious threat to national security.

The Biden administration has argued that the Chinese government needs to access the personal data and private information of its US users, making the nation incredibly vulnerable to potential cyber attacks.

When the law emerged, TikTok immediately responded by denying any espionage threats or ties to the Chinese government, insisting that the law violated the First Amendment rights of American citizens.

While the law may seem like a violation of Americans’ constitutional rights, the Biden administration said its implementation was justified because of the massive threat it posed to the nation’s security.

An attempt as short as a TikTok video

While this lawsuit has been discussed in tech and social media circles for years, oral arguments will only last a few minutes.

The Biden administration will have 25 minutes to present its case, while TikTok itself, as well as a group of content creators, will have a short period of time to defend against the ban.

The law requires that any legal challenge to the Biden edict be heard directly by the U.S. Court of Appeals for the District of Columbia Circuit, bypassing the federal district court altogether.

Because of this bypass, a full trial will not take place and a final decision will be made by a three-judge panel, resulting in a shorter time frame for a court proceeding that could last only a few weeks.

The final decision will determine whether or not the law is constitutional, allowing for a potential ban on TikTok in the US.

TikTokers attack the Biden administration

TikTokers have taken the saying “Don’t bite the hand that feeds you” to heart.

A group of eight TikTok creators are standing behind the company that helped them go viral, suing the Biden administration over the law that wants to kick the social media app out of the US.

However, these TikTokers will only have 10 minutes to present their case.

Their goal is to prevent this law from being implemented by explaining to the court why it should find Biden’s rule unconstitutional, not apply it to American citizens, and grant continued access to the app.

The Biden administration will then hold a closing presentation for the final 25 minutes to make its case.

There is no exact date when the court will reach a final decision, but the deadline is January 19, meaning Americans will get an answer to the social media app’s future in the coming weeks.

Oral arguments took place on Monday, September 16 at 9:30 a.m. ET.
